Honour Legal provides an online LPA document-preparation and guidance service. Using the service does not create a solicitor-client relationship and is not a substitute for independent legal advice where your circumstances require it.
1. About these terms
These Terms of Service govern your use of the Honour Legal website and the Lasting Power of Attorney services supplied by Honour Legal Limited ("Honour Legal", "we", "us" or "our"), a company registered in England and Wales under company number 16858194.
By accessing the website you agree to the website-use provisions in these terms. By creating an account, submitting an application or purchasing a service, you also agree to the provisions relating to our LPA service.
Our Privacy Policy also applies to the way we collect and use personal information. If you do not agree with these terms, you should not use or purchase the service.
You must be at least 18 years old to purchase the service. A person making an LPA (the donor) must also be at least 18 and have mental capacity when making it.
2. Our LPA service
Honour Legal specialises in preparing Lasting Power of Attorney documents for use under the law of England and Wales. Depending on the service or package shown to you before purchase, our service may include:
- a guided online questionnaire;
- preparation of Property and Financial Affairs and/or Health and Welfare LPA documents from the information you provide;
- pre-filled information for the relevant Office of the Public Guardian forms;
- general guidance about signing, witnessing and registration;
- administrative or common-error checks where these are expressly included in your chosen service;
- secure account access to your saved application and documents; and
- printing, postage or other support where expressly included in the package you purchase.
The exact service included in your order is the service described on the website and checkout page at the time you purchase. Anything not expressly included is not part of the contract.
3. What our service is not
Our online service is designed to help you prepare LPA documents from your answers. Unless we expressly agree otherwise in writing, we do not act as your solicitor, provide individual legal opinions, tax advice, financial advice or assess every aspect of whether an LPA or a particular choice is suitable for your circumstances.
You should obtain independent advice from a suitably qualified professional if your circumstances are unusual or complex, if there is disagreement within the family, concern about mental capacity or undue influence, significant overseas assets, business interests, trusts, tax issues, safeguarding concerns, or if you are unsure about the legal effect of a choice you are making.
General information on our website is provided to explain the LPA process and should not be treated as personalised legal advice.
4. Your responsibilities
You are responsible for giving us accurate, complete and truthful information. In particular, you must carefully check names, dates of birth, addresses, attorney details, replacement attorney details, certificate-provider details, people to notify, preferences and instructions before your documents are finalised.
You must tell us promptly if information changes before your documents are finalised. You must not knowingly provide false, misleading or unauthorised information about another person.
Where you complete an application for somebody else, you confirm that you are authorised to provide the information and that the donor remains responsible for understanding and making the decisions contained in their LPA.
If two people use a couple journey, each LPA remains a separate legal document for its individual donor.
5. Signing, witnessing and registration
An LPA is not effective merely because Honour Legal has prepared the form. The document must be signed, dated and witnessed correctly, in the required order, by the relevant donor, certificate provider, attorneys and witnesses, and it must be registered by the Office of the Public Guardian (OPG) before it can be used.
You are responsible for following the signing and witnessing instructions supplied with your documents. You should not make handwritten alterations, crossings-out or other changes to the issued form unless you have confirmed that doing so is permitted.
If you are unsure how to sign or witness the document, contact us before signing or seek independent legal advice. We are not present when the documents are signed and cannot supervise the execution process.
A Health and Welfare LPA can only be used when the donor is unable to make the relevant decision. A Property and Financial Affairs LPA may, if the document allows it, be used after registration while the donor still has capacity and gives permission.
6. Prices, payment and OPG fees
The Honour service price payable by you is the price displayed and confirmed at checkout. Prices are in pounds sterling. Any VAT that is legally chargeable will be included in the consumer price shown.
We may change prices for future orders, but a later price change will not alter the price already agreed for an existing paid order.
The OPG registration fee is separate from Honour's service fee. As at the date these terms were last updated, the standard OPG fee is £92 for each LPA, subject to any exemption or reduction for which the donor qualifies. The fee charged by the OPG at the time of registration will apply if the government changes it.
Unless your checkout expressly says otherwise, the OPG fee is paid separately to the Office of the Public Guardian and is not collected by Honour Legal.
7. Cooling-off, cancellation and refunds
If you are a consumer purchasing online, you will normally have a legal right to cancel the service contract within 14 days of the contract being made, subject to the rules below.
Starting work during the 14-day period
If you ask us to start providing the service before the 14-day cancellation period ends, we may begin work once the required request or consent has been obtained. If you then cancel before the service is fully completed, we may charge a reasonable amount proportionate to the service actually supplied up to the time you cancel.
If the service is fully performed within the 14-day period after you expressly requested early performance and acknowledged that your cancellation right would be lost once the service was fully performed, the statutory cancellation right for that completed service may end at that point.
Digital documents
Where your package includes immediately downloadable digital documents, we will obtain any consent and acknowledgement required by law before supply begins during the cancellation period. Once digital content supply has begun following the required express consent and acknowledgement, the normal statutory cancellation right for that digital content may end.
Faulty or incorrectly supplied services
Nothing in these terms removes your statutory rights. If our service is not supplied with reasonable care and skill, is not as described, or digital content does not meet the rights that apply under consumer law, you may have rights to repeat performance, repair, replacement, a price reduction, refund or other remedies depending on the circumstances.
To request cancellation or a refund, contact us using the details in section 23 and include your name, email address and order reference where available.
8. OPG timescales
The Office of the Public Guardian is a government body and its processing time is outside our control. The government currently states that registration usually takes around 8 to 10 weeks where there are no mistakes or objections, but the actual time may be longer.
We do not guarantee a particular registration date and are not responsible for delay caused solely by OPG processing times, OPG queries, objections or other matters outside our reasonable control.
9. Changes and corrections
You should review your information carefully before checkout and again before signing. If you notice an error before the documents are signed, contact us as soon as possible.
Whether a correction, replacement pack or reprint is included without charge depends on the cause of the error, the stage the order has reached and the service you purchased. We will not charge an undisclosed fee. Any charge for additional work will be explained and agreed before it is incurred.
If an error was caused by our failure to provide the service with reasonable care and skill, your statutory remedies are not restricted by this section.
10. England, Wales and overseas use
Our LPA service prepares documents under the law of England and Wales for registration with the Office of the Public Guardian for England and Wales. Different legal arrangements apply in Scotland, Northern Ireland and other jurisdictions.
A donor does not necessarily have to live in the United Kingdom to make an England and Wales LPA, but the suitability and recognition of the document can depend on the donor's circumstances and where assets, institutions or decisions are located.
We do not guarantee that an LPA prepared for England and Wales will be accepted by a bank, authority, court or other organisation outside England and Wales. If you need the document to operate overseas, you should obtain legal advice in the relevant jurisdiction.
11. Accounts and website use
You are responsible for keeping your account credentials confidential and for activity carried out through your account. Tell us promptly if you believe somebody has obtained unauthorised access.
You must not misuse the website, attempt to access another person's account, interfere with security, scrape the service using automated systems without permission, introduce malicious code, attempt unauthorised access to our systems, or use the service for unlawful or fraudulent purposes.
We may suspend access where reasonably necessary to protect users, investigate suspected misuse, comply with law or maintain the security of the service.
12. Intellectual property
Honour Legal or its licensors own the intellectual property rights in the website, branding, software, questionnaire structure, original explanatory content and other materials we create, except for government forms or third-party material which remains owned by its respective rights holder.
You may use documents prepared specifically for your order for your own LPA purposes, including printing, signing, sharing them with the people involved in your LPA and submitting them for registration. You must not resell, commercially exploit, reproduce for third parties or use our service to create a competing product without permission.
13. Information and documents you provide
You keep ownership of information and documents you provide to us. You give us permission to use, store, reproduce and process that material only as reasonably necessary to provide the service, operate your account, support you, prevent fraud and meet our legal obligations.
You must have the right to provide any material you upload. You are responsible for keeping your own copies of important original documents.
14. Website availability and security
We aim to keep the website available and secure, but we do not promise uninterrupted or error-free access. We may temporarily suspend or restrict parts of the website for maintenance, security, technical or operational reasons.
You are responsible for using appropriate device and account security. You must not knowingly introduce viruses, malware, malicious code or attempt a denial-of-service or other attack.
15. Third-party links and services
Our website may link to government websites, payment providers, address lookup services or other third parties. A link does not mean we control or endorse all content on the third-party site. Third-party services may be subject to their own terms and privacy notices.
16. Responsibility and liability
We will provide our service with the reasonable care and skill required by law. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that cannot lawfully be excluded under consumer law.
We are not responsible for loss caused solely by inaccurate, incomplete or misleading information you supplied, by a decision you made contrary to clear information provided to you, or by your failure to follow correct signing, witnessing or registration instructions, provided that our own service and guidance were supplied with reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was made or for losses that were not caused by a breach by us. If you use the service wholly or mainly for business purposes, we are not responsible for business losses such as lost profit, lost revenue or loss of business opportunity unless the law requires otherwise.
No wording in these terms prevents you from pursuing the legal remedies available to you where Honour Legal has breached the contract or failed to exercise reasonable care and skill.
17. Post and delivery
If your package includes postal delivery, we may use Royal Mail or another delivery provider. Delivery estimates are not guaranteed and carrier delays can occur outside our control.
We are not responsible for delay, loss or damage caused solely by a third-party postal provider where we have taken reasonable care in arranging dispatch. This does not exclude responsibility for our own breach. If a delivery problem occurs, contact us and we will take reasonable steps to help investigate and, where appropriate, arrange replacement documents.
When returning signed documents, you should consider using an appropriate tracked or signed-for postal service and keep proof of posting.
18. Privacy and data protection
We process personal data in accordance with applicable UK data-protection law. Our Privacy Policy explains the categories of information we collect, why we use it, how it is stored and the rights available to individuals.
LPA applications can contain sensitive information about donors, attorneys, certificate providers and other people. You should only provide information that is necessary for the service and that you are entitled to provide.
19. Complaints
If you are unhappy with the service, please contact us first so we can investigate. Include your order reference and a clear description of the issue where possible.
We will acknowledge complaints and aim to deal with them fairly and within a reasonable time. Nothing in our complaints process removes any statutory right or external redress route available to you.
20. Changes to these terms
We may update these terms for future use to reflect changes in law, government forms, technology, security or the way our service operates. We will update the date shown at the top of this page when we do so.
The terms applicable to a paid order will normally be the version presented when that contract was made. We will not use a later change to remove rights or materially reduce the service already agreed without a lawful basis and, where required, your agreement.
21. Governing law
These terms and contracts for our service are governed by the law of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer, the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts where you live. If you are a business user, the courts of England and Wales will have exclusive jurisdiction.
22. General terms
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we delay enforcing a right, that does not mean we have waived it. You may not transfer your contract to another person without our agreement, except where the law gives you that right. We may transfer our rights or obligations where this does not reduce your consumer rights.
These terms, the service description shown at purchase, the checkout information and our Privacy Policy form the agreement between you and us relating to the service you purchase.
